Who provides the paperwork in a For Sale By Owner (FSBO) transaction?

 

In a full sale by owner transaction paperwork is first provided by the seller, because you're going to have to sign a contract with the buyer. Typically in the county where I practice, in Broward/Miami-Dade county, the buyer selects the settlement agent. Once you have a settlement agent, then the settlement agent's going to prepare what's called a conveyance document, so the seller's documents, which the seller has to sign, which consists of the warranty deed, an affidavit, such as the owner's no lean affidavit, and the seller's affidavit, and maybe some other affidavits that the settlement agent is going to require.

 

However, they're going to charge you a fee for this, but you're also are entitled to have an attorney prepare these documents for you. The benefit of course is that the attorney can represent you at the closing and answer whatever questions you may have.
